§ 78205 Statute Severability Clause

Key Takeaways

  • •This law should be understood in a broad and flexible way.
  • •If one part of this law is found to be invalid or doesn't work, the rest of the law still applies.
  • •The law is designed so that the valid parts can still be used even if some parts are removed.

Example

Imagine a law that says you can't have loud parties after 10 PM and you must keep your yard clean. A court decides the 'no loud parties' rule is unfair.

Even if the 'no loud parties' rule is thrown out, you still have to keep your yard clean. The rest of the law still works.
