§ 65003 Statute Severability Clause

Key Takeaways

  • •If one part of this law is found to be invalid or doesn't work, the rest of the law can still be used.
  • •The law is meant to be understood in a broad and flexible way.
  • •If a part of the law doesn't apply to a certain person or situation, it doesn't mean the whole law is useless.

Example

Imagine a law about school rules that says kids must wear uniforms and bring their own lunch. If a court says the uniform rule is unfair, the lunch rule can still be enforced.

Even if one part of the law is thrown out, the rest of the law can still be used as long as it makes sense without the invalid part.
