§ 74006 Statute Severability Clause

Key Takeaways

  • •This law should be understood in a broad and flexible way.
  • •If one part of this law is found to be invalid or doesn't work, the rest of the law still applies.
  • •Each part of this law can stand on its own, even if another part is removed.

Example

Imagine a law that says you can't have loud parties after 10 PM and you must keep your yard clean. One day, a court says the part about loud parties is unfair.

Even though the loud party rule is thrown out, you still have to keep your yard clean. The rest of the law still works.
