§ 110745 Food Component Misbranding Rules

Key Takeaways

  • •If a food is meant to be used in another food, it must be safe and truthful.
  • •If following the instructions on the package makes the final food unsafe or lying about what it is, the food is misbranded.
  • •The seller must make sure their product doesn’t make the final food bad or misleading.

Example

A company sells a powder labeled as 'sugar-free cake mix' but when you bake it as directed, the cake ends up having hidden sugar in it.

The cake mix is misbranded because it lies about being sugar-free, and when used as directed, it makes a misleading final product.
