§ 9920 Legislative Rule Adoption

Key Takeaways

  • •The Senate and Assembly must make their own rules for how they work, and they need at least two-thirds of their members to agree on these rules.
  • •If they want to change a rule later, they still need two-thirds of their members to agree.
  • •They can pause a rule for a short time if two-thirds of the members present agree, but only if enough members are there to make decisions.
  • •This pause only works for the thing they're talking about right then and doesn't last after they take a break.

Example

Imagine the Senate wants to change a rule about how long they can talk about a new law.

They can only change this rule if at least two-thirds of the Senate members vote 'yes' for the change. If they just want to ignore the rule for one discussion, they can do that with a two-thirds vote too, but only if most members are there, and it only applies to that one discussion.

Any standing rule of either house may be suspended temporarily by a vote of two thirds of the Members of that house present and voting; provided, that in no case may a rule be suspended in the absence of a quorum. Any such temporary suspension shall apply only to the matter under immediate consideration, and in no case shall it extend beyond an adjournment. (Added June 5, 1984, by initiative Proposition 24.)
