§ 20515 Federal Service Coverage Exclusion

Key Takeaways

  • •This rule lets some workplaces change how they count work time for retirement benefits.
  • •If your job was covered by both state and federal retirement rules, your workplace can choose to ignore the federal part for most benefits.
  • •This change only applies to people hired after the new rule starts.
  • •The workplace had to agree to this rule between 1995 and 2001.

Example

A teacher worked at a school that followed both state and federal retirement rules. The school changed its contract in 1996 to use only the state rules for most benefits.

If the teacher was hired after 1996, their retirement benefits will mostly follow state rules, not federal ones. But some benefits, like those in Article 3, still follow both.
