§ 5762 Pest Eradication Public Nuisance

Key Takeaways

  • •If the government says an area has a bad bug or plant problem, that bug or plant is officially a 'public nuisance'.
  • •Anything that helps the bug or plant spread (like infected plants or dirty tools) is also a problem.
  • •The government can make people get rid of the bug, plant, or anything helping it spread.

Example

A neighborhood has a bad problem with a plant disease that kills trees.

The government can say this disease is a public nuisance. If your tree has the disease, they can make you cut it down or treat it so it doesn’t spread to other trees.
