§ 16003 Unified District Grade Apportionments

This law says that when a unified school district asks for state money, "grade level maintained" means kindergarten through 12th grade, and the district can ask for money for one grade level, the other, or both, but it can skip the rule for the first three years if it sends a written notice.

Key Takeaways

  • •"Grade level maintained" means kindergarten and grades 1‑12.
  • •A district can apply for money for one grade level, the other, or both.
  • •During the first three years after the law starts, a district can ask to be exempt by sending a written notice.

Example

A brand‑new unified school district that started in 2022 wants money to help its kindergarten and its 8th‑grade classes.

Because the law says "grade level maintained by the district" includes kindergarten through 12th grade, the district can apply for money for either the kindergarten, the 8th grade, or both. Since the district is only a year old, it can also send a written notice to the state board to be exempt from this rule for the first three years if it chooses.

§ 16003 Unified District Grade Apportionments

With respect to applications filed on and after the effective date of this section by a unified district and any apportionments and repayments made under the applications, “grade level maintained by the district” means the kindergarten, if any, and grades 1 to 12, inclusive, maintained by the district. A unified district if otherwise eligible, may apply for and receive an apportionment for either one or both of the grade levels. This section shall not apply to a unified district during the first three years following the effective date of this section, or during the first three fiscal years in which the district is in existence for all purposes, if the governing board of the district transmits to the board a written notice stating the district desires to be exempted from this section during that period. (Repealed and added by Stats. 1996, Ch. 277, Sec. 2. Effective January 1, 1997. Operative January 1, 1998.)
