§ 16012 School Property Disposal Rules

This law says the state board tells schools how to sell or get rid of property that’s being replaced with state money, and the money from the sale is used to lower the amount the school owes the state.

Key Takeaways

  • •The board writes the rules for how replaced property must be sold or disposed of.
  • •Schools must follow those rules to get the state money.
  • •Money from the sale is used to reduce the school’s apportionment (the amount the state owes the school).
  • •The board can take title to the property and sell it to get the highest price for the state.
  • •If needed, the board can also approve demolition of the old facility and count that cost toward the apportionment.

Example

A school district gets state funds to replace an old gym. The old gym must be sold according to the board’s rules.

The district follows the board’s instructions to sell the gym. The cash from the sale is taken off the bill the state owes the district for the new gym. If the board wants, it can take the gym title itself, sell it, and use that money to cut the district’s bill.

§ 16012 School Property Disposal Rules

The board shall prescribe instructions specifying the manner in which property, real or personal, being replaced through the apportionment, shall be disposed of, and compliance with the instructions shall be a condition upon the making of the apportionment. The net proceeds derived from the disposition shall be contributed in reduction of any apportionment. Any school district affected shall comply with instructions prescribed by the board. The board may require a district to transfer to the state, by any instruments deemed appropriate by the board, title to property, whereupon, the board shall dispose of the property in any manner it deems appropriate to insure the highest return to the state, and apply the proceeds therefrom in reduction of apportionments to the district. The district affected shall do all things deemed necessary by the board to implement the disposition. Whenever the board determines it to be in the best interests of the state, an apportionment may be made for the demolition of any facilities replaced through an apportionment. This section shall be applicable to property replaced by apportionments heretofore or hereafter made under this chapter or Chapter 6 (commencing with Section 15700) of this part. (Repealed and added by Stats. 1996, Ch. 277, Sec. 2. Effective January 1, 1997. Operative January 1, 1998.)
