§ 2819 Water Rights Supplemental Decrees

Key Takeaways

  • •If you apply for water rights under the Water Commission Act, the board handles it even after a court decree.
  • •Once the board gives you a license and the court checks it (if needed), the court will confirm your right to the water.
  • •If the board allows any changes to your water rights later, the court will update the decree to match.

Example

A farmer applies for water rights to irrigate their fields.

The board reviews and approves the farmer's request, giving them a license. If the farmer or the board asks, the court will confirm the farmer's right to use that water. If the farmer later needs to change how they use the water, the board can approve it, and the court will update the official records.
