§ 79935 Environmental Cleanup Cost Liens

Key Takeaways

  • •If someone pollutes land or water, the government can make them pay for the cleanup.
  • •The government can put a legal claim on the polluter's property until they pay up.
  • •Even if the polluter has no money, the claim stays on their property.
  • •The polluter gets a chance to argue their case in court before the claim is final.

Example

A factory dumps toxic waste into a river, and the government has to spend money to clean it up.

The government can force the factory owner to pay for the cleanup. If the owner doesn’t pay, the government can take a legal claim on the factory’s land until the bill is paid—even if the owner is broke.
