§ 40482 South Coast Delegation Authority

Key Takeaways

  • •The south coast board can give some of its jobs to the executive officer to do.
  • •The executive officer must follow the board's directions when doing these jobs.
  • •If the board doesn't say they're keeping a job for themselves, it's automatically given to the executive officer.
  • •The board must officially vote and write it down if they want to keep a job for themselves.

Example

The south coast board is in charge of keeping beaches clean.

The board can tell the executive officer to handle the day-to-day beach cleaning tasks. If the board doesn't say they want to decide how to clean a specific beach, the executive officer can make that decision. But if the board votes and writes in their notes that they want to decide how to clean that beach themselves, then the executive officer can't do it.

§ 40482 South Coast Delegation Authority

The south coast district board may delegate duties to the executive officer as it deems appropriate. The executive officer shall perform and discharge, under the direction and control of the south coast district board, the powers, duties, purposes, functions, and jurisdiction vested in the south coast district board and delegated pursuant to this section. Any power, duty, purpose, function, or jurisdiction which the south coast district board may lawfully delegate is conclusively presumed to have been delegated to the executive officer unless it is shown that the south coast district board, by affirmative vote recorded in its minutes, specifically has reserved the particular power, duty, purpose, function, or jurisdiction for its own action. (Amended by Stats. 1987, Ch. 1301, Sec. 16.)
