§ 101485 Waste Site Jurisdiction Authority

This law says that it does NOT stop the environmental department, regional water board, or state water board from taking charge of a place where waste has been released and from enforcing rules there.

Key Takeaways

  • •The law does not block the department from taking jurisdiction over a waste release site.
  • •Regional and state water quality boards can also take jurisdiction and enforce actions at waste sites.
  • •It works together with other parts of the law that already cover waste sites.

Example

A factory accidentally spills hazardous waste into a nearby creek.

Even though other laws might apply, the environmental department can still step in and manage the clean‑up, and the water boards can also take action to enforce cleanup rules.
