§ 38450 Park Land Discontinuance Protests

Key Takeaways

  • •If people complain about stopping the use of park land, the government listens unless most of them (two-thirds) vote to ignore the complaints.
  • •The government can agree with some complaints and ignore others for different parts of the same park.
  • •If complaints are ignored, the government can decide to have a special vote where everyone in the city can say if they want to stop using that park land.

Example

A group of neighbors doesn’t want a park turned into a parking lot. They complain to the city.

The city council listens to their complaints. If not enough council members (less than two-thirds) vote to ignore the complaints, the park stays as it is. If two-thirds of the council votes to ignore the complaints, the city can hold a special vote for all city residents to decide if the park should become a parking lot.
