§ 38446 Park Discontinuance Notice Posting

Key Takeaways

  • •If a park is going to be closed or stopped from being a park, the people in charge must put up at least three signs around the park to let everyone know.
  • •The signs must be easy to see and not too far apart (no more than 300 feet).
  • •The signs must be put up at least 20 days before the meeting where they will talk about closing the park.
  • •If they forget to put up the signs, it doesn’t mean the meeting or the decision to close the park is canceled.

Example

Imagine your local park is going to be turned into a shopping mall.

The people in charge must put up signs around the park at least 20 days before they have a meeting to talk about closing it. If they don’t put up the signs, the meeting can still happen, and they can still decide to close the park.

The park superintendent or another person designated by the legislative body shall cause at least three notices of the adoption of the resolution to be posted conspicuously not more than three hundred feet apart along the exterior boundaries of the area proposed to be discontinued and abandoned as a public park. Posting shall be completed at least twenty days before the time set for the hearing. Failure to post the notices does not invalidate the proceedings or prevent the legislative body from acquiring jurisdiction to proceed with the discontinuance and abandonment.
