§ 12962 Complaint Service Requirements

Key Takeaways

  • •If someone complains about unfair treatment at work, the complaint must be officially given to the person or company accused of doing wrong.
  • •The complaint can be handed over in person, sent by certified mail, or delivered in other official ways listed in the law.
  • •If the person who complained hires their own lawyer, the lawyer must handle delivering the complaint, not the government.
  • •The complaint must be delivered either right when the government first contacts the accused or within 60 days, whichever happens first.

Example

A worker files a complaint saying their boss didn't hire them because of their race.

The government must officially give this complaint to the boss, either by handing it to them in person or sending it by certified mail. If the worker has a lawyer, the lawyer must do this instead. This has to happen quickly, either right away or within 60 days.
