§ 77312 Pepper Producer Referendum Requirements

Key Takeaways

  • •This law only starts working if enough pepper farmers and handlers vote 'yes' in a special vote.
  • •At least 40% of all pepper farmers must vote, and either 65% of them must say 'yes' (and they must have sold more than half of last year's peppers) OR more than half say 'yes' (and they must have sold at least 65% of last year's peppers).
  • •The same rules apply to pepper handlers (people who process or sell peppers for farmers).
  • •If not enough people vote or the 'yes' votes don’t meet these rules, the law doesn’t start.

Example

Imagine 100 pepper farmers in California. For this law to start, at least 40 of them must vote. Then, either 26 of those 40 (65%) must vote 'yes' and those 26 must have sold more than half of all peppers last year, OR at least 21 of those 40 (more than half) must vote 'yes' and those 21 must have sold at least 65% of all peppers last year.

The law needs a strong 'yes' vote from farmers who grow a lot of peppers, not just a few small farmers. The same goes for handlers. If the big pepper sellers don’t support it, the law won’t start.
