§ 65567 Commissioner Vacancy Election Rules

Key Takeaways

  • •If a commissioner quits, dies, or can't do the job, their spot needs to be filled.
  • •The other commissioners in the same area pick someone to take the empty spot.
  • •They vote, and if most agree, the new person gets the job until the next normal election.
  • •If the spot opens up less than six months before a normal election, they can just wait and fill it then.

Example

A commissioner in your town moves away and quits their job.

The other commissioners in your town will pick someone new to take their place. They vote, and if most like the person, they get the job until the next big election. If the next big election is in five months, they might just wait and let the people vote then.

§ 65567 Commissioner Vacancy Election Rules

In the event the office of a commissioner becomes vacant due to failure to qualify, resignation, disqualification, death or for any other reason, such position shall be filled by an election held by the commission. Nominations shall be received by the commission from the remaining commissioners in the district where the vacancy exists. An election shall then be held by the commission and a majority vote shall elect a commissioner, subject to appointment by the director, to fill out the unexpired term for which such election is being held. Vacancies occurring within six months prior to a regular district election may remain vacant until the next regular election. Commission members elected at special elections shall serve the unexpired term of the office to which they are appointed. (Amended by Stats. 1971, Ch. 1105.)
