Key Takeaways

  • •If a handler member leaves their job for any reason, a new person must take their place.
  • •The new handler is chosen by other handler members and approved by the director.
  • •If possible, the new handler should come from the same area as the one who left.
  • •If the job opens up less than six months before an election, it can stay empty until the election.

Example

A handler member in a farming district quits their job.

The other handler members in that district will pick someone new to take the job. The director then approves this person. If the job opens up close to an election, they might wait until the election to fill it.

§ 66580 Handler Vacancy Appointment Rules

If the position of a handler member becomes vacant due to failure to qualify, resignation, disqualification, death, or for any other reason, the position shall be filled by a qualified handler who is nominated by the handler members of the commission and appointed by the director. Handlers to be considered for appointment to fill any such vacancy shall, if possible, be handlers whose names are submitted for consideration by the remaining handler members of the district in which the vacancy occurs. Any nomination requires a plurality of votes cast by the handler members. The appointment to a vacated handler member position is for the unexpired term of office. Any vacancy of a handler member position occurring within six months prior to a regular district election may remain vacant until the next regular election. (Amended by Stats. 1983, Ch. 555, Sec. 18.)
