§ 62802 Nut Contract Violation Penalties

Key Takeaways

  • •If you buy nuts under a contract that breaks the rules, you have to pay the seller what the nuts are really worth.
  • •If the contract was made after September 7, 1983, you also pay a penalty: twice the difference between what you paid and what the nuts are worth.
  • •If the contract was made before September 7, 1983, you pay the nuts' real value plus twice that value as a penalty.

Example

A store buys almonds from a farmer under a contract that doesn't follow the rules. The almonds are worth $10,000, but the store only pays $7,000.

The store must pay the farmer the real value of the almonds ($10,000) plus a penalty. If the contract was made after September 7, 1983, the penalty is twice the difference ($3,000 x 2 = $6,000), so the store pays $16,000 total. If the contract was made before that date, the penalty is twice the real value ($10,000 x 2 = $20,000), so the store pays $30,000 total.
