§ 18574 Voter Eligibility Question Refusal

This law says that if a person is told by the election board to take an oath and then refuses to take it or refuses to answer questions about someone's right to vote, they can be charged with a misdemeanor.

Key Takeaways

  • •If the precinct board tells you to take an oath, you must do it.
  • •If you are sworn in, you must answer any relevant questions about someone's voting rights.
  • •Refusing either the oath or the answers can lead to a misdemeanor charge.

Example

A volunteer at a voting precinct is asked by the precinct board to swear an oath and then is asked whether a neighbor who moved recently is allowed to vote. The volunteer says no and refuses to answer.

Because the volunteer refused to be sworn in and refused to answer the board's question about the neighbor's voting right, the law says they could be charged with a misdemeanor.
