§ 18562 Precinct Board Ballot Secrecy

This law makes it a crime for a precinct board member to try to see who a voter voted for before the ballot is put in the box.

Key Takeaways

  • •Precinct board members cannot try to find out any name on a ballot before it is cast.
  • •They cannot open, look at, or let anyone look at a folded ballot that has just been handed in.
  • •They cannot mark or add anything to a folded ballot to discover who the voter chose.

Example

A precinct board member opens a folded ballot that a voter just handed over to see the names on it.

Because the board member looked at the sealed ballot before it was placed in the ballot box, the law says they have committed a misdemeanor.
