§ 18570 Election Results Tampering

This law makes it a misdemeanor to mess with posted election results within 48 hours after polls close, or to delay or change the results that must be sent to election officials.

Key Takeaways

  • •Removing or damaging posted vote results within 48 hours after voting is illegal.
  • •Changing or delaying the vote results that must be sent to city or county election officials is illegal.
  • •Doing either can lead to a misdemeanor charge.

Example

A person pulls down a posted list of vote totals from a city hall bulletin board two days after the election and throws it away.

Because the list was taken down within 48 hours of the polls closing, the person broke the law and could be charged with a misdemeanor.
