§ 9809 Priority Of Conflicting Claims

Key Takeaways

  • •This law decides who gets paid first if two people claim the same thing (like a car or house) as payment for money owed.
  • •If the fight over who gets paid first started before July 1, 2014, the old rules apply.
  • •If the fight started after July 1, 2014, the new rules apply.

Example

Imagine two people both say they have the right to take your car because you owe them money.

If you promised your car to both of them before July 1, 2014, the old rules decide who gets the car. If you made the promises after that date, the new rules decide.

§ 9809 Priority Of Conflicting Claims

The changes to this division made by the act adding this chapter determine the priority of conflicting claims to collateral. However, if the relative priorities of the claims were established before those changes become operative on July 1, 2014, this division as it existed before those changes become operative determines priority. (Added by Stats. 2013, Ch. 531, Sec. 23. (AB 502) Effective January 1, 2014. Operative July 1, 2014, by Sec. 28 of Ch. 531.)
