§ 17305 Conflicting Claims Priority

Key Takeaways

  • •This law decides who gets paid first if multiple people claim the same property (like a car or money).
  • •If the rules for who gets paid first were set before January 1, 2024, the old rules still apply unless changed by this new law.
  • •On a specific date (the 'adjustment date'), some old rules about who gets paid first for certain types of property (like electronic money) stop working, and the new rules take over.

Example

Imagine you borrowed money to buy a car, and the bank has a claim on it. Later, someone else says they also have a claim on the same car because you owe them money too.

This law helps decide who gets paid first if the car has to be sold. If the bank’s claim was set before 2024, the old rules apply. If the new law changes things, the new rules decide who gets the money from selling the car.
