§ 9362 Stop Payment Notice Deadlines

Key Takeaways

  • •If you file a 'stop payment notice' for a public project, the government must tell you within 10 days how long you have to sue for payment.
  • •This notice happens after the project is done or after a 'notice of cessation or completion' is recorded.
  • •The government doesn’t have to send this notice unless you paid them $10 when you filed your stop payment notice.

Example

You worked on building a new school and didn’t get paid, so you file a stop payment notice.

The school district must tell you within 10 days after the project ends how long you have to take them to court to get your money—but only if you paid them $10 when you filed your notice.
