§ 90070 District Formation Election Requirements

Key Takeaways

  • •The county can call an election to create a new district if either of two things happen.
  • •First way: People from all seven cities can sign a petition. At least 5% of voters from each city must sign.
  • •Second way: The city councils of all seven cities can pass a resolution agreeing to the election.
  • •A mix of petitions and resolutions is okay, as long as all seven cities are on board.

Example

Imagine seven small towns near San Diego want to create a new school district together.

If at least 5% of voters in each town sign a petition, or if each town's council votes yes, then the county will hold an election to decide if the new district is created.

A petition may be on separate papers, but each paper shall contain the affidavit of the person who circulated it, certifying that each name signed thereto is a true signature of the person whose name it purports to be. (b) A resolution of consent calling for the formation of the district is filed with the board of supervisors from each of the city councils of the seven cities specified in Section 90050; provided, that the requirements of this section shall be deemed to have been met if a combination of petitions and resolutions of consent have been filed with the board of supervisors, so long as each of the seven cities specified in Section 90050, either through a petition or by a vote of the city council, has authorized the calling of an election for the formation of the district.
