§ 27283 City Tax Liability After Exclusion

Key Takeaways

  • •If a city cuts off a piece of land, the city and the board must agree on how much of the taxes and debts that land should still pay.
  • •If they can't agree, they can go to court to figure out a fair amount.
  • •The court will use normal rules for deciding this kind of problem.

Example

A small town votes to leave the bigger city it was part of.

The town and the city can't agree on how much of the city's old debts the town should help pay. They go to court, and the judge decides the town should pay 10% of the debts because that's fair based on its size.
