§ 102550 Transit Equipment Purchase Authority

This law lets the district buy or lease buses and other transit vehicles, pay for them over time, and only own them once all payments are finished.

Key Takeaways

  • •The district may buy or lease transit vehicles like cars, trolley buses, and motorbuses.
  • •It can use equipment trust certificates and lease agreements just like private transit companies do.
  • •Payments can be made in installments, and the district only gets full ownership after all installments are paid.

Example

The district wants a new trolley bus but doesn’t have all the cash up front.

The district can sign a lease or get an equipment trust certificate, pay for the bus in monthly installments, and the bus stays owned by the lender until the last payment is made.

§ 102550 Transit Equipment Purchase Authority

The district shall have power to purchase transit equipment such as cars, trolley buses and motorbuses, or rolling equipment, and may execute agreements, leases, and equipment trust certificates in the forms customarily used by private corporations engaged in the transit business appropriate to effect such purchase and leasing of transit equipment, and may dispose of such equipment trust certificates upon such terms and conditions as the board may deem appropriate. Payment for such equipment, or rentals therefor, may be made in installments, and the deferred installments may be evidenced by equipment trust certificates payable from any source or sources of funds specified in such certificates that are or will be legally available to the district; and title to such equipment shall not rest in the district until the equipment trust certificates are paid.
