§ 102412 Transit Employee Displacement Protection

This law says the district can’t buy, sell, lease, or combine any transit system unless it first takes care of workers who might lose their jobs, and those worker protections have to be negotiated with the union.

Key Takeaways

  • •The district can’t contract for any transit services or buy/sell any part of a transit system without first protecting displaced employees.
  • •Employee protection plans must be negotiated with the union (collective bargaining).
  • •The rule applies to all ways of getting or getting rid of transit services—purchase, lease, condemnation, merger, etc.

Example

The district wants to sell its bus fleet to a private company.

Before the sale can happen, the district must first set up a plan to help the bus drivers and other staff who could lose their jobs—like offering new positions, severance pay, or retraining—and that plan has to be bargained with the union.
