§ 1208 Trust Beneficiary Notice Requirements

This rule says you usually don’t have to tell the people who will get money from a trust about legal notices, unless special situations apply.

Key Takeaways

  • •Normally, you don’t have to give notice to trust beneficiaries.
  • •If the personal representative is also the trustee (or there is no trustee), you must notify anyone who would get money now or if the trust ends.
  • •If the trust has more than one trustee and a co‑trustee (who isn’t the personal representative) gets notice, you still don’t have to notify the beneficiaries.

Example

A person dies and the estate is run by someone who is also the trustee of a family trust. The law says that person must notify the people who would get money now or if the trust ends, but does not have to notify every possible future beneficiary.

Because the personal representative is also the trustee, the law requires notice only to those who would actually receive money right now or would get it if the trust were ended, not to all the trust’s beneficiaries.

§ 1208 Trust Beneficiary Notice Requirements

(a) Except as provided in subdivision (b), if notice is required to be given to a trust or trustee, notice to trust beneficiaries is not required. (b) Subject to subdivision (c), where the personal representative and the trustee are the same person, or where no trustee has been appointed, notice shall be given to (1) each person to whom income or principal would be required or authorized in the trustee’s discretion to be currently distributed if the trust were in effect, or (2) if there are no such persons, to each person who, under the terms of the trust, would be entitled to any distribution if the trust were terminated at the time the notice is required to be given. (c) Notice to trust beneficiaries is not required under subdivision (b) where the trust has more than one trustee and notice is given to a cotrustee who is not a personal representative.
