§ 1200 Notice Requirements Governance

This part tells you which rules to follow for giving notices, unless another rule says something different, and it says old notices from before July 1 1991 still follow the old law.

Key Takeaways

  • •This part controls notice rules unless another specific rule overrides it.
  • •If a specific rule conflicts with this part, the specific rule wins.
  • •Notices sent, mailed, posted, or first published before July 1 1991 keep using the old law.

Example

A landlord mailed a rent‑increase notice to a tenant on June 15 1991.

Because the notice was sent before July 1 1991, the landlord must follow the notice rules that were in effect at that time, not the rules in this part.

(a) Except as otherwise provided in this code, this part governs notice required or permitted under this code. (b) This part does not apply to notice under a particular provision to the extent that the particular provision is inconsistent with this part. (c) This part does not apply to the giving of a particular notice where the notice was delivered, mailed, posted, or first published before July 1, 1991. The applicable law in effect before July 1, 1991, continues to apply to the giving of that notice, notwithstanding its repeal. (Enacted by Stats. 1990, Ch. 79.)
