§ 8580 Cemetery Land Use Restrictions

Key Takeaways

  • •Land used for a cemetery must stay a cemetery unless a court says it can change.
  • •To change it, the cemetery must prove no one is buried there or all graves were moved.
  • •The court must agree after a hearing before the land can be used for something else.

Example

A small town has an old cemetery that hasn't been used in 50 years. The town wants to turn part of it into a park.

The town must go to court and show that no one is buried in that part of the cemetery. If the court agrees, they can remove the cemetery status and build the park.
