§ 8558 Cemetery Property Dedication Protection

Key Takeaways

  • •Once land is made a cemetery, it stays a cemetery even if the people in charge go away or stop using it.
  • •No one can take away or sell your burial plot, even if the cemetery has money problems or gets sold.
  • •The rules about who owns the plots don’t change, even if the cemetery is sold or has other big problems.

Example

A family buys a burial plot in a cemetery. Later, the cemetery goes out of business and the land is sold to a new owner.

The family still owns their burial plot, and the new owner can’t take it away or change who owns it. The land stays a cemetery, and the family’s plot is safe.
