§ 6979 Wastewater System Repair Requests

Key Takeaways

  • •If your home's sewage system is broken and causing problems, you can ask the local government to fix or replace it.
  • •The government can decide to fix it if it's possible, and they might pay for some or all of the work.
  • •The workers who fix it can put a legal claim on your property if you don't pay, and the government can take over this claim if they helped pay for the work.

Example

Your toilet keeps backing up because the sewage system in your yard is broken, and it's making your neighborhood smell bad.

You can ask the city to fix it. If they agree, they might pay for the repairs. If you don’t pay the workers, they can put a claim on your house, and the city can take over that claim if they paid for part of the work.

The zone, in the discretion of the board, may pay all, or any part, of the cost or price of the work done and materials furnished; and, to the extent that the zone pays the cost or price of the work done and materials furnished, the zone shall succeed to and have all the rights, including, but not limited to, the lien, of such person or persons employed to do the work against the real property and the owner.
