§ 79950 Department Liability Exemption

Key Takeaways

  • •The government department is not responsible for cleaning up a place with dangerous chemicals just because they put a claim or lien on it.
  • •This rule is about who has to pay for cleaning up messy or dangerous spots with bad stuff in them.
  • •Even if the department says 'you owe money' for the cleanup, they aren’t saying 'we’ll do the cleanup'.

Example

A factory leaks bad chemicals into the ground and the government says the factory owner must pay to clean it up.

The government can tell the factory owner to pay, but the government isn’t saying they’ll clean it up themselves. They’re just making the owner pay.
