§ 79370 Illegal Drug Site Cleanup

Key Takeaways

  • •If someone uses a place to make illegal drugs, they are responsible for any dangerous chemicals left there or spilled.
  • •The government or health officers can clean up the dangerous chemicals and sign papers as if they made the mess, but they are not to blame for it.
  • •People who work for the government and help with the cleanup are not responsible for the dangerous chemicals being there.

Example

Someone sets up a secret lab in a garage to make illegal drugs. They leave behind dangerous chemicals that could hurt people or the environment.

The person who made the drugs is responsible for the dangerous chemicals left in the garage. The government can come in to clean up the mess and sign papers saying they are in charge of the cleanup, but they are not the ones who caused the problem.
