§ 78905 Emergency Hazardous Site Cleanup

Key Takeaways

  • •If a place with dangerous chemicals is on a special list, the state can spend money to clean it up without waiting for extra paperwork.
  • •The state can only do this if the people responsible for the mess were told to clean it up but didn’t listen.
  • •The state must have already told the responsible people that they didn’t follow the rules and that the site is being sent to the department for cleanup.

Example

A factory spilled toxic chemicals into a river and was ordered to clean it up, but they ignored the order.

The state can step in and use its own money to clean up the river without waiting for more agreements because the factory didn’t follow the rules.
