§ 41982 Toxic Waste Incineration Permits

Key Takeaways

  • •The state must create rules for burning toxic waste safely.
  • •They must talk to experts and the public before making these rules.
  • •The rules must consider how dangerous the waste is and how to stop pollution.
  • •The rules should follow federal guidelines unless there's a good reason not to.

Example

A factory wants to burn old chemicals to get rid of them.

The factory must follow the state's rules for burning toxic waste. These rules make sure the factory doesn't pollute the air and keeps people safe. If the factory doesn't follow the rules, they could be fined or shut down.

The state board shall, after completing the study referred to in Section 41981, in consultation with the affected districts, the Department of Toxic Substances Control, and the Office of Environmental Health Hazard Assessment, and after public hearings, establish guidelines for the issuance of permits by the districts for the incineration of toxic waste materials. The guidelines shall take into consideration factors including, but not limited to, the following: (a)  The characteristics of the toxic waste materials to be incinerated. (b)  The methods or equipment available to minimize or eliminate the emission of air contaminants. (c)  The applicable federal standards, including, but not limited to, the regulations in Part 264 of Title 40 of the Code of Federal Regulations (40 CFR 264) concerning standards for owners and operators of hazardous waste treatment, storage, and disposal facilities. Where the guidelines deviate from the adopted federal standards, the reason for the difference shall be noted by the state board. (Amended by Stats. 2000, Ch. 343, Sec. 19.
