§ 2012 District Formation Notice Requirements

Key Takeaways

  • •Before asking people to sign a petition to create a new district, the people in charge must explain why they want to create it and how it will be paid for.
  • •This explanation must be published in a newspaper that people in the area read. If the area covers more than one county, it must be published in a newspaper in each county.
  • •Within five days after the explanation is published, the people in charge must give a copy of it and a note from the newspaper confirming it was published to the local government office.
  • •Only after doing all this can they start asking people to sign the petition.

Example

A group of people want to create a new school district in their area.

Before they can ask people to sign a petition to create this new school district, they must write a short explanation about why they want to create it and how it will be paid for. They need to publish this explanation in the local newspapers. After that, they have to give a copy of the explanation and a note from the newspaper to the local government office. Only then can they start asking people to sign the petition.
