§ 11473 Seizure Disposal And Exceptions

Key Takeaways

  • •If the police take stuff (not cars, boats, planes, or money) because of a crime, the court can order it to be destroyed if the owner is found guilty.
  • •If the stuff taken is clean science equipment, the police can ask the court to give it to a school instead of destroying it.
  • •This rule doesn’t apply to vehicles, boats, planes, money, or valuable items like stocks.

Example

The police take lab equipment from someone making illegal drugs.

If the person is found guilty, the court can order the equipment to be destroyed. But if the equipment is clean and useful, the police can ask the court to give it to a school for science class instead.
