§ 19814 Fire Marshal Seizure Authority

Key Takeaways

  • •If a store sells something super flammable (like certain chemicals or fireworks) and breaks the fire safety rules, the Fire Marshal can take those items away.
  • •The Fire Marshal can destroy the taken items after 30 days, or after 10 days if there’s a legal fight about it.
  • •The store owner can’t just keep dangerous stuff if it’s against the rules—it will be taken and thrown away.

Example

A gas station sells fireworks that are too powerful and not allowed by state fire rules.

The Fire Marshal can take those fireworks away. If no one fights it in court, after 30 days, the Fire Marshal can destroy them to keep people safe.
