§ 112480 Fresh Food Cold Storage Ban

Key Takeaways

  • •You can't sell old food as 'fresh' if it was kept in cold storage.
  • •This rule doesn't apply to 'fresh frozen' foods if they're labeled right and stored at zero degrees or colder.
  • •Eggs can be kept in cold storage for up to 30 days and still be called fresh.

Example

A grocery store sells strawberries that were picked 6 months ago and kept in cold storage, but the sign says 'fresh strawberries'.

This is against the law because the strawberries are not fresh—they were kept in cold storage. The store can't call them fresh unless they follow the rules for 'fresh frozen' foods.
