§ 111610 Drug And Device Exemptions

Key Takeaways

  • •Old drugs or devices sold before a big federal law was made don’t have to follow the rules in Section 111550 if their labels and ads stayed the same.
  • •Drugs that are approved under special health laws (like the Virus-Serum-Toxin Act) also don’t have to follow Section 111550.

Example

A company sold a special soap in 1940 with a label saying it cures colds. The same soap is still sold today with the exact same label.

This soap doesn’t have to follow the new rules in Section 111550 because it was sold before the big federal law and nothing on its label changed.
