§ 106879 Civil Liability Enforcement Options

This law lets the state board fine people or companies for breaking water rules, and lets the Attorney General also sue them in court if the board asks, but you can't be fined twice for the same mistake.

Key Takeaways

  • •The state board can impose civil liability (a fine) on its own.
  • •If the board asks, the Attorney General can also bring a civil lawsuit in superior court.
  • •Civil penalties add to any other punishments, but you can't get both an administrative fine and a court fine for the same violation.

Example

A water treatment plant releases polluted water into a river, breaking the Water Code.

The state board can give the plant a civil penalty right away, or the Attorney General can take the plant to court to get a penalty, but the plant can't be hit with both a board fine and a court fine for that same spill.
