§ 100885 Laboratory Certification Enforcement

This law says a lab that needs a special certificate or TNI accreditation must have it, and if it doesn’t, the state board can go to court to stop the lab from working.

Key Takeaways

  • •Labs that do work needing certification or TNI accreditation must be certified or accredited first.
  • •If a lab works without the required certification, the state board can sue to get a court order stopping the lab.
  • •The board can also ask the court to force a lab to follow the rules and do anything else needed to make it comply.

Example

A lab tests drinking water for a city but never got the required TNI accreditation.

The state board can file a lawsuit, and a judge can order the lab to stop testing until it gets the proper accreditation.
