§ 102970 Fetal Death Registration Compliance Review

This law tells the health department to check fetal death reports every year and, if a doctor or facility files those reports late more than 25% of the time, to let the medical board or funeral bureau know.

Key Takeaways

  • •The department must review fetal death reports at least once a year.
  • •The review does not decide who is to blame for late filings.
  • •If an individual or entity files late more than 25% of the time, the department must electronically notify the appropriate licensing board.

Example

A hospital files 12 fetal death reports in a year, but 4 of them are filed after the deadline.

Because 4 out of 12 is more than 25%, the department will send an electronic notice to the Medical Board of California so they can look into why the hospital is late.

How to Calculate

(Number of late registrations ÷ Total registrations) × 100 > 25

  1. Count how many fetal death registrations were filed late in the calendar year.
  2. Count the total number of fetal death registrations filed in that year.
  3. Divide the late count by the total count.
  4. Multiply the result by 100 to get a percentage.
  5. If the percentage is greater than 25, the department must send a notification.

Hospital with 12 registrations, 4 late.

Result: (4 ÷ 12) × 100 = 33.3% → 33.3% is more than 25%, so the hospital is considered to have repeated failures.

§ 102970 Fetal Death Registration Compliance Review

(a) The department shall regularly, but no less than annually, review fetal death registrations completed pursuant to this chapter to determine whether there is a failure to comply with the required timeframes for fetal death registration pursuant to Section 102950. The department’s review is not required to include a determination of culpability for any late registrations. (b) If the department identifies repeated failures to comply with the timeframe required by Section 102950, the department shall electronically notify the Medical Board of California, the Cemetery and Funeral Bureau, or other relevant licensing entity of an individual’s or entity’s failure to timely comply with fetal death registration requirements. Notwithstanding Section 102430, the department’s electronic notification shall include the information necessary for the relevant licensing entity to adequately investigate the identified untimely fetal death registration. (c) For purposes of this section, “repeated failures” means an individual’s or entity’s failure to timely comply with fetal death registration requirements more than 25 percent of the time in a calendar year.
