§ 75057 Nonmember Judge Retirement Allowance

• •If you're not a member of the retirement system, your retirement pay is based on the salary of the judge who currently holds the position you last had.
• •The salary used to calculate your retirement pay is the one being paid at the time you start getting your retirement money.
• •This rule applies to judges who retired or were eligible to retire starting from June 1, 1988.

Judge Smith retired in 1990. Today, Judge Johnson holds the same position Judge Smith had. Judge Smith's retirement pay is based on Judge Johnson's current salary.

Even though Judge Smith is no longer working, his retirement pay is calculated using the salary of the judge who has his old job now.
