§ 75091 Judicial Survivor Death Benefits

Key Takeaways

  • •If a judge dies after working 10-19 years, their spouse gets a monthly payment. The amount is 1.625% of the current judge's salary for each year the deceased judge worked.
  • •If a judge dies after working 20+ years, their spouse gets a monthly payment equal to 37.5% of the current judge's salary.
  • •The payment starts right after the judge dies and stops when the spouse dies.
  • •If the spouse can get money from another rule (Section 75104.4), they get that instead, not this one.

Example

A judge who worked for 15 years dies while still working. Their spouse is alive.

The spouse will get a monthly payment. The amount is 1.625% of the current judge's salary for each of the 15 years the deceased judge worked. So, 1.625% x 15 x current judge's salary.
