§ 54130 Local Agency Loan Approval

Key Takeaways

  • •A local agency (like a city or county) can't take a loan if it would break the rules in Section 18 of Article XI of the Constitution.
  • •To take the loan, the local agency must ask the people who live there to vote. At least two-thirds of the voters must say 'yes' to the loan.
  • •The vote must follow the same rules as when the local agency wants to borrow money by selling bonds.
  • •Even if other laws say the local agency can't borrow money, they can still take this loan if the voters approve it.

Example

A small town wants to borrow money to build a new park.

The town can't just decide to take the loan on their own. They have to ask the people who live in the town to vote. If at least two-thirds of the voters say 'yes,' then the town can take the loan and build the park.
